The morning of September 7 brought with it a big smile on Apurv’s face, reason was obvious – there was no more hiding, no further mums and no more questions on dodging of marriage. The historic verdict by the Supreme Court of India on Section 377 was a lullaby to him last night, what else can make him so ecstatic! Actions mentioned under Section 377 are no longer a criminal offence. The debatable issue on the rights of the LGBTQ community is given a legal status. Their identity apart from being ‘Man & woman’ from today will be categorised into Lesbian, Gay, Bisexual, Transgender and Queer, with no discrimination and fear.

Remarkable Verdict Frees Society From Shackles

Within 21 days of the India’s Independence Day, this remarkable verdict has helped this section of society to be freed from the shackles of segregation, hatred and exploitation. It was rightly said by Justice Indu Malhotra, “History owes an apology to LGBTQ persons for ostracization, discrimination.”

No More Tragedy & Anguish

Every individual has the right to have bodily autonomy. The LGBTQ community should be allowed to live with dignity and without pretence. Our constitutional essence is Liberty which should be respected for individual choice. The section imposed by Macaulay years before independence is still followed in a democratic country like India, this itself is a hammer stroke on our liberal constitution. Tragedy and anguish inflicted by section 377 seems to have been remedied.

No Subjugation Of Sexual Minority

There is a majoritarianism of society who condemn homosexuality, even deny their existence. For them, ‘God has made Man and Woman only’ and no other gender exists beside these two. Their deep-rooted gender stereotypes have decided boundaries between what is permissible or not, persecuting people on their sexual preference.

It is a majoritarian impulse to subjugate a sexual minority to live in silence for a long and exorbitant time. Just think of any of your friend who has ever said of liking a person of same gender, or donning characteristics opposite to what imposed by the society, how abysmally you and other people mocked at him! How did you react if any of your friend of your gender touches you, you reflexively reverted?

Imagine what trauma has the person been suffering from who was excluded from society, even by his own family for his sexual identity. What miserable conditions are the KINNERS or the transgenders living in for the last many years? We have so judgementally adorned them with titles of hijras and chhakkas! Although this sound to be abuses to us!! Imagine another realm where homosexuality is normal and being heterosexual is a taboo boycotted by society. What grief and pain would be inflicted on you if your human instinct to love had been constrained? These dogmas are nothing but our narrow-mindedness and forbid to accept LGBTQ community as our own.

Living With People Of Same Orientation Is N A T U R A L

This verdict is not just a ray of hope but also a claimed right for every individual who was discriminated, mocked, threatened till yesterday and every person who declared it as unnatural. To build a colony by clearing forests is unnatural, to construct dams obstructing the flow of rivers is unnatural, spreading web of roads by cutting mountains is unnatural, BUT to love, live with people of same orientation is NATURAL! Criminalising carnal sex is irrational, arbitrary.

Colors To LGBTQ Community, Their Life
