In a historic judgement, a 5-judge bench of the Apex Court – The Supreme Court of India on Thursday unanimously legalized consensual adult gay sex thus partially abolishing Section 377. All the five judges signed the order and now Homosexuality in India gets legal approval and recognition.

Supreme Court abolishes 158-yr-old colonial law

The 158-years old colonial law holding gay sex as a criminal offense was turned down and thus allowed gay sex among consenting adults in private.

Homosexuality A Natural Trait

It is also reportedly known that Justice Indu Malhotra has held that the members of LGBT community owe an apology and also reportedly stated that homosexuality is a natural trait and its penal suppression infringes a host of fundamental rights.

Sexual orientation is a Biological Phenomenon

The judges also reportedly held the sexual orientation as biological phenomenon and held that any kind of discrimination on this ground is violative of fundamental rights.
